Agency accounts are more beneficial for businesses wanting to extend their customer base and increase revenue by offering this extra service to the general public

 

AGENTS - Terms and Conditions

Agents Terms and Conditions of Service.

 

1) In these terms ‘The Garment Spa’ means the service/goods provider. The ‘Customer’ means the person or business receiving the service or goods.

2) These terms are the agreement between ‘The Garment Spa’ and the ‘Customer.’

3a) The Garment Spa will provide dry cleaning, laundry services and associated products. The services shall be carried out by The Garment Spa with all reasonable skill and care, and in full compliance of relevant established current professional standards.

3b) As a Garment Spa agent you agree, to only use and promote The Garment Spa service and branding. Any independent promotions or press releases to include The Garment Spa must be approved by The Garment Spa before going to print.

4a) This agreement is for the duration of twelve months and will automatically roll over unless cancelled, in writing, fourteen days prior to the renewal date. These terms commence and are binding from the first day of service.

4b) This agreement may be terminated by The Garment Spa or the Customer, in writing, fourteen days before the renewal date or with immediate effect if either party are in breach of this agreement.

5) Dates and times quoted for delivery are subject to confirmation at the time of collection. In any event time shall not be of the essence. The Garment Spa, whilst making every effort to affect prompt deliver, will not be liable for loss or damage occasioned by delay in delivery, howsoever caused and any delivery dates or times quoted are given subject to this condition.

6) Damage or unsatisfactory work must be reported within three days of delivery. Any claim that the goods are not in accordance with the Agreement or there is any shortage on delivery must be made within three days of delivery. Failing such notice The Garment Spa will accept no liability for damage, shortage or mis-delivery.

7a) Payment for service or goods must be made in full on delivery unless other terms have been agreed (shown below). Once work has been completed by The Garment Spa the Customer is responsible for payment in full. Credit terms may be withdrawn without notice or reason.

7b) All point of sale, literature, books etc. provided by The Garment Spa always remains the property of The Garment Spa and on termination of this agreement must be returned, in reasonable condition or a charge will be made to compensate the loss or damage.

8a) For late payments, the following month’s commission will be reduced by 5% and not reinstated until regular payments have been re-established.

8b) Any outstanding monies will be charged interest of 8% above the Bank of England base rate per month from the date of which the debt has been incurred. Returned cheques will incur an administration fee of twenty-five pounds in addition to any bank charges.

9) If debts are not cleared within a time The Garment Spa deems reasonable The Garment Spa will pass the Customer’s debt (including a late payment charge) on to an agency for collection and the Customer will abide by their terms and conditions, including any additional costs.

10) Directors of any limited companies will be held personally responsible for any monies owing to The Garment Spa from that company, at all times, including interest and costs incurred for debt recovery.

11) Prices may be changed by The Garment Spa without prior notice.

12) For monies owing, The Garment Spa reserve the right to withhold any goods from the Customer until the debt has been recouped in toto.

13) The terms of this Agreement shall be governed by and construed in accordance with English law and be subject to the non-exclusive jurisdiction of the English Courts.

3c) Trade customers will supply all of their own promotional literature and necessary accessories i.e. ticket books, pins etc.
